Executive Order in Missouri

The conflict surrounding hemp has now reached Missouri. In a surprising move, the Governor of Missouri signed an executive order today that bans food products containing delta-8 THC, delta-10 THC, THC-O, THCP, THCV, HHC, and similar substances. These items are now considered unapproved and adulterated under state law.

The executive order labels these substances as psychoactive cannabis products that lack safety standards, packaging requirements, and regulatory oversight in Missouri.

Importantly, the FAQs accompanying the order clarify that non-psychoactive substances like CBD and CBN are not affected by this ban. However, this sweeping measure does inadvertently include some hemp products that are federally legal.

Efforts backed by the marijuana industry to enforce legal bans on hemp products have repeatedly failed in the Missouri legislature in recent years. This latest maneuver by a Governor nearing the end of his term is unprecedented and raises significant concerns.

The ban is set to take effect on September 1, pending necessary regulatory procedures. More importantly, a legal challenge to this extraordinary measure is anticipated.
